Welcome to the website for CIRQL.

1. Acceptance of Terms

By downloading, registering for, or using the CIRQL application, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you must not use CIRQL.
These Terms constitute a legally binding agreement between you and CIRQL Ltd. We reserve the right to update these Terms at any time. Continued use of the platform after any update constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 18 years of age to use CIRQL. By using the platform you confirm that you meet this requirement. We reserve the right to suspend or terminate accounts where we have reason to believe a user is under 18.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at support@cirql.uk if you become aware of any unauthorised use of your account.
You agree to provide accurate and current information when registering and to keep your account details up to date.

4. User Generated Content and Live Streaming Responsibility

CIRQL takes no responsibility and assumes no liability for any content that you or any other user broadcasts, posts, shares or otherwise makes available through the platform.

You are solely responsible for any content you broadcast or publish through CIRQL and the consequences of making it available on the platform. You agree that CIRQL acts only as a passive conduit for the transmission and publication of your content and bears no liability for what you choose to broadcast.

By going live on CIRQL you confirm that:

  • You are in a location where filming and broadcasting is permitted, whether by law, by the consent of the landowner, or by both
  • You have obtained and are solely responsible for obtaining all consents required by law to broadcast any content featuring third parties
  • You have the written consent of each and every identifiable natural person appearing in your broadcast, or that your broadcast takes place in a genuinely public or semi-public space where individuals do not have a reasonable expectation of privacy
  • Your broadcast complies with the UK General Data Protection Regulation and you accept sole responsibility for any content that constitutes unlawful processing of personal data
  • You will take particular care not to broadcast content in which children are identifiable, and you acknowledge that CIRQL operates an active moderation system with the right to terminate any stream at any time

Any violation of the above constitutes a material breach of these Terms and may result in immediate suspension or termination of your account.

5. Prohibited Content

You must not broadcast, post, or share any content that:

  • Is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Contains nudity, sexual content, or graphic violence
  • Depicts or endangers minors in any way
  • Incites hatred on the basis of race, religion, gender, sexual orientation, disability, or any other protected characteristic
  • Infringes the intellectual property rights of any third party
  • Constitutes spam, unsolicited advertising, or commercial solicitation without our prior written consent
  • Is broadcast in a location where filming is prohibited, including private property without the landowner’s permission, medical facilities, places of worship without consent, or any location where individuals have a reasonable expectation of privacy

6. Content Moderation

CIRQL operates an automated content moderation system that monitors live streams in real time. We reserve the right to terminate any stream, remove any content, or suspend any account at our sole discretion where we believe a violation of these Terms or our Community Guidelines has occurred or is likely to occur.

Automated moderation does not guarantee that all prohibited content will be detected. You should not rely on our moderation system as a substitute for your own responsibility to comply with these Terms.

7. Intellectual Property

You retain ownership of content you create and broadcast on CIRQL. By broadcasting or uploading content to CIRQL, you grant us a non-exclusive, royalty-free, worldwide licence to transmit, store, display, and make available that content to other users of the platform for the purposes of operating the service.

CIRQL and its logo, branding, and technology are the intellectual property of CIRQL Ltd. You must not reproduce, distribute, or use any of our intellectual property without our prior written consent.

8. Privacy Locations and Sensitive Spaces

You must not broadcast live streams in locations where individuals have a reasonable expectation of privacy. This includes but is not limited to private residences, medical facilities, changing rooms, places of worship without the explicit consent of the relevant authority, and any space designated as private or restricted.

Broadcasting in Camden Market or any other privately owned space requires the permission of the landowner. If CIRQL has a formal partnership with a venue or location, the terms of that partnership govern what broadcasting is permitted within that space.

9. Referral Programme

CIRQL may operate a referral and creator incentive programme from time to time. The terms of any such programme, including eligibility, reward thresholds, and payout conditions, will be published separately within the app. CIRQL reserves the right to amend or discontinue any incentive programme at any time.

Payouts under the referral programme are subject to manual review and approval by CIRQL. We reserve the right to withhold or reverse any payout where we have reason to believe the referral activity was fraudulent, abusive, or in breach of these Terms.

10. Limitation of Liability

To the maximum extent permitted by law, CIRQL Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the platform, including any content broadcast by other users.

Our total liability to you for any claim arising out of or in connection with these Terms or your use of CIRQL shall not exceed the greater of £100 or the amount you have paid to us in the three months preceding the event giving rise to the claim.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.

11. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, where we believe you have violated these Terms or where we consider it necessary to protect the safety of our users or the integrity of the platform.

You may delete your account at any time through the app settings. Upon termination, your right to use CIRQL will cease immediately. Sections of these Terms that by their nature should survive termination will continue to apply.

12. Governing Law

These Terms are governed by the laws of England and Wales. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
